According to the Tax Increase Prevention and Reconciliation Act of2005 (TIPRA 2005), if a taxpayer decides to make monthly payments, i.e. Taxpayers must include with their offer the first monthly payment. A compromise offer will prevent tax levies as per section 301.7122(g),(1) of the US Federal Tax Regulations. This regulation says that the IRS won't levy on taxpayers' property while an offer in compromise (an offer accepted for processing) is pending. If rejected, it will remain there for thirty days. The IRS can't levy on taxpayers property while they appeal the rejection. It is not possible to release a levy that is already in effect at the time of submission.

You’ll also need to make an initial payment, and it’s non refundable as well. Your initial payment has to be either 20% of what you’re offering to pay (if you're paying in five or fewer installments) or your first monthly installment (if you're paying in six or more monthly installments).
